前言
我們這次來探討另一類在澳門十分常見的牌照—由澳門教青局 (DSEDJ) 管轄的補習社與持續教育中心的牌照。全何人在澳門經營補習業務,只要經營規模超過第17/2022號法律第二條第九款的規定,簡單來說,若收生人數超過四人,或透過公開方式招生,就需要申請相關牌照。
在澳門,補習社和督課中心在官方的正式名稱為「私立補充教學輔助中心」(Centros de Apoio Pedagógico Complementar Particulares),它們適用於第17/2022, 12/2023號法律制度。而持續教育中心的官方名稱為「私立教育機構(持續教育)」(Instituições Educativas Particulares - Educação Contínua),這類中心仍然適用於第38/93/M號及第38/98/M號法令的相關規定。
其實,這類看似簡單的牌照,卻是澳門各類牌照中最容易掉入陷阱的一種。所以篇小文章,"其他細節"部份才是精華,我們在這裡先來作一個簡單的介紹。
Introduction
Let’s take a look at a common type of licence in Macau—tutorial centre and continuing education centre licences under the Direcção dos Serviços de Educação e de Desenvolvimento da Juventude (DSEDJ).
In Macau, if your tutorial business exceeds the provisions of Article 2, Clause 9 of Law No. 17/2022 essentially, enrolling more than four students or recruiting publicly, you’ll need to apply for the relevant licence.
Tutorial centres and supervision centres are officially called “Centros de Apoio Pedagógico Complementar Particulares" , regulated by Law No. 17/2022. Continuing education centres, officially termed Instituições Educativas Particulares - Educação Contínua, are governed by Decree-Law No. 38/93/M and Decree-Law No. 38/98/M.
Despite their straightforward appearance, these licences are some of the trickiest in Macau. Here’s a brief introduction to them.
有關補習社/督課中心選址選址
補習社,簡單來說有以下要求:
設於商業用途、寫字樓用途或社會設施用途;
場所具獨立性,除了私立教育機構 ;託兒所或社會服務設施外,不可同時用於經營其他業務,且可直達所處樓宇的共同通道或公共道路;
具有適當的通風、照明、衛生、消防安全等條件;
然後就是持續教育中心,簡單來說有以下要求:
設於商業用途、寫字樓用途或社會設施用途;
具有適當的通風、衛生、消防安全等條件;
“中心”具獨立性;
適當之自然通風條件及照明 ;
地面層或以上樓層 ;
About location Requirements
Let’s start with tutorial centres. In simple terms, the following criteria apply:
The premises must be designated for commercial, office, or social facility use
The location must be independent and cannot be used for other businesses, except for private educational institutions, nurseries, or social service facilities. It must also have direct access to shared building passages or public roads.
The premises should meet appropriate standards for ventilation, lighting, hygiene, and fire safety.
Now, moving on to continuing education centres. In essence, the following criteria apply:
The premises must be designated for commercial, office, or social facility use.
It should meet adequate standards for ventilation, hygiene, and fire safety.
The centre must be independent.
Natural ventilation and lighting must be appropriate.
Located on the building ground floor or higher
申請手續
其實,兩者的申請手續和過程十分相似,主要區別在於文件的數量和種類。
首先,你需要找到設立場所的位置(無論是租賃還是購買)。接著,根據你的場所佈置情況,需向土地工務局以M4表格形式提交(不限於):建築計劃、消防計劃以及採光和通風資料。
根據指引,若場所面積少於100平方米且未進行改建工程,可直接向工務局提交經核準的工務局蓋印圖(如何取得?)。此外,你還需為你的場所準備一個只有中文,或英文加葡語的名稱(名稱必須符合法規要求,詳情請參閱《私立教育機構(持續教育)》和《非高等教育私立補充教學輔助中心》名稱指引)。
另外還需提交一個詳盡的場所描述、持牌人或法人代表的身份證明文件副本和刑事紀錄證明書、身心建康證明、緊急代任人聲明書。完整版包括公司章程之公司商業登記 和委任書(當持牌人是法人時),場所的所有權或使用樣證明文件,消防運作良好保證書等。
如果你申請的是補習社,當向教青局提交申請表及其他所需資料時,則還需要以下資料 (可透過商社通辦理)
遞交填妥的申請表(所有文件必需由持牌人本人簽名及蓋章)。所有合乎相度資格的協調員和教學輔助人的身份證明文件,學歷和專業資格,身心建康證明。
如果是持續教育中心
遞交填妥的申請表C04(文件可以正式授權人提供,但建議做筆跡鑑證)、領導機關成員及教學人員身份證明文件副本專業資格證書、紀錄證明書、身心建康證明、課程大鋼、中心章程。
Application Procedures
The application procedures for both types are quite similar, with the main differences being the number and type of documents required.
Firstly, you need to find a location for your establishment (whether rented or purchased). Then, depending on your layout, you must submit the following to the DSSCU using the M4 form: building plan, fire safety plan, and lighting and ventilation information.
According to the guidelines, if the area is less than 100 square metres and no renovation work has been done, you can directly submit the approved stamped plan from the DSSCU(How to get it?). Additionally, you need to prepare a bilingual name (Chinese or English with Portuguese) for your establishment, which must comply with regulations. For details, refer to the naming guidelines for “Instituições educativas particulares (de educação contínua) ” e “centros de apoio pedagógico complementar particulares do ensino não superior” - Instruções para a denominação"
You also need to submit a detailed description of the premises, copies of the identity documents and criminal record certificates of the licensee or legal representative, health certificates, and an emergency replacement declaration. The complete set includes the company's articles of association, commercial registration, and appointment letter (if the licensee is a legal entity), proof of ownership or usage of the premises, and a fire safety certificate.
If you are applying for a tutoring centre, when submitting the application form and other required documents to the Education and DSEDJ, you also need the following: (PEA is avaiable)
Completed application form (all documents must be signed and stamped by the licensee).
Identity documents, qualifications, and health certificates of all coordinators and teaching assistants.
If you are applying for a continuing education centre:
Completed application form C04 (documents can be provided by an authorised person, but handwriting verification is recommended).
Copies of identity documents, professional qualification certificates, criminal record certificates, health certificates, course outlines, and the centre's articles of association.
其他有趣的細節
有關經營場所採光通風要求的細節
在自然與人工採光混合的環境下,照明度需達到最低500 lux。此外,需具備良好的自然通風與機械通風系統,以確保每人每小時獲得至少17立方米的新鮮空氣。需要特別注意的是,雖然補習社在《第17/2022號法律》第十一條中,將《第38/98/M號法令》第三條的「適當的自然通風條件及照明」修訂為「具備適當的通風條件及照明」,但根據目前的申請要求,教青局在審批兩種牌照時,仍然堅持設施需具備自然採光。一般而言,採光面積與學生使用面積的比例需達到1:10,但兩人小班教室可豁免此規定。
有關場所專屬性的要求
有關補習社的要求,除了教青局近年常引用《第6/99/M號法令》第七條這條空泛的規定作為規範框架外,更為重要的是基於《第17/2022號法律》的要求,場所需具備“獨立性”,且不可同時用於經營私立教育機構與托兒服務外的其他業務。因此,在審批牌照的慣例中,教青局對“場所具獨立性”的解釋為需提供完整且單一物業的登記書面報告(即查屋紙)作為單位。
雖然本澳現行法規中對“場所 (Estabelecimento)”的定義並非以分層產權證明的獨立查屋紙為去決定,但由於教青局的行事準則如此,建議大家不必浪費過多時間去和當局爭論。
至於持續教育中心,同樣受《第6/99/M號法令》第七條這一框架的限制,但在場所是否需具專屬性方面,則受《第38/98/M號法令》第三條的規定約束,條文寫法則變為要求須"確保“中心”具備獨立性與安全性"。根據教青局近年的做法,即使屬於同一物業的登記書面報告(查屋紙),只要經由土地工務局更改工程計劃完成分割,並於圖則上附有分割後的編號以及完成消防驗收,仍可被視作符合要求。雖然手續相對繁複,但相比補習社的限制,靈活性相對更大。
有關學生私隱的要求
當大家經過地面商舖的補習中心時,可能會注意到一個奇特現象:外立面的大幅玻璃貼著大約1.8米高的磨砂貼。當時,相關部門要求保護孩童隱私,因此建議在原有的採光玻璃上貼磨砂貼。然而,之後相關職員又認為,磨砂貼或磨砂玻璃可能導致光線不自然,與《第17/2022號法律》第十一條的自然採光要求相衝突。
也許大家心裡會疑惑,實際上補習中心內的所有照明幾乎完全依賴人工光源,而外立面的大幅玻璃只是為了滿足一條用途不明的法規。所以光線是否自然真的重要嗎?至於為何磨砂玻璃會被認為不符合自然採光要求,我也無法解答大家的疑問。不過,據說當時有一名"天才"提出解決方案 - 在1.8米以下貼磨砂貼,而1.8米以上保持透明,就可以同時滿足隱私保護和採光需求。
因此,我們建議正立面的玻璃最好採用15mm或以上的強化全透明玻璃窗(怎樣決定玻璃厚度?),並根據行政當局的最新規定再決定是否需要貼上磨砂貼,以確保符合要求。
還有那些雜七雜八的注意事項
經營區域的淨高須至少達到2.6米,且補習社室內不得設置高於1.2米的屏障。根據《第39/2022號法律》第一百一十條的要求,場所的所有門必須向外開啟但又不能佔用公共區。此外,若您的服務包含托管、接送、膳食服務或其他受《第17/2022號法律》第二條規範的活動,則需要遵守相關要求。重點說一下若場所提供膳食,嚴格來說,您所提供的食品必須符合《第5/2013號食品安全法》的規定。理論上,以小作坊形式且無牌經營的供應商很難達到這些要求。不過,由於涉及跨部門執法,除非發生重大食品安全事故,日常執法通常不會過於嚴格,但仍希望經營者能自律守法。
Additional Details:
Regarding the lighting and ventilation requirements for business premises:
a minimum lighting level of 500 lux must be achieved through a combination of natural and artificial light. The premises should also feature adequate natural and mechanical ventilation, ensuring at least 17 cubic metres of fresh air / person per hour.It is worth noting that while the Tutoring Centres Act (17/2022) revised the previous regulation under Decree-Law 38/98/M from “appropriate natural ventilation and lighting conditions” to “appropriate ventilation and lighting conditions,” the DSEDJ still requires natural lighting when approving licences. Typically, the ratio of natural lighting area(window) to student use area should meet a 1:10 standard, though this requirement is exempt for small classrooms designed for two students.
Requirements for Premises Exclusivity:
Regarding tutoring centres, while DSEDJ often references the broad and vague framework of Article 7 in Decree-Law 6/99/M, the key requirement under Law 17/2022 is that premises must have “exclusivity” and cannot be used for other activities, such as operating private educational institutions or childcare services. The bureau interprets “exclusivity” to mean the submission of a complete and singular property registration report (commonly referred to as a “property report”).
Although the current Macau regulations do not strictly define a Estabelecimento) by independent property rights with separate property reports, it is recommended not to engage in extended disputes over this with the authorities, as their practice stands.
As for continuing education centres, they are similarly constrained by Article 7 of Decree-Law 6/99/M. However, regarding premises exclusivity, they are governed by Decree-Law 38/98/M, which requires that centres ensure both “independence” and “safety.” Under recent DSEDJ practices, even if a centre shares the same property registration report, as long as the property has undergone segmentation via approved changes to construction plans with unique identifiers on the plans and completed fire safety inspections, it can be deemed acceptable. Though this process may be more complex, it offers greater flexibility compared to tutoring centres
Regulations on Student Privacy:
When passing by tutoring centres located in ground-floor shops, you might notice an unusual feature: large glass facades covered with frosted film up to a height of about 1.8 metres. This was initially required by the authorities to protect children's privacy, prompting the application of frosted film to existing glass panels. However, officials later argued that frosted film or frosted glass might disrupt natural lighting, conflicting with the requirements of Law 17/2022, Article 11, for natural light.
You may wonder why this is an issue, as most of the lighting inside these centres comes from artificial sources, and the large glass facades seem intended only to satisfy unclear regulations. Why frosted glass is deemed incompatible with natural lighting is a question without a clear answer. However, a clever solution was proposed by a clever people....... - to apply frosted film below 1.8 m while keeping the upper part transparent. This approach balances privacy protection with lighting requirements.
We recommend using fully transparent tempered glass of at least 15mm thickness(How to choose glass?) ( for the facade and adapting to the latest regulatory changes from the authorities to decide whether frosted film is necessary
Other miscellaneous Notes:
The premises must have a minimum ceiling height of 2.6 metres, and no barriers taller than 1.2 metres may be installed inside the tutoring centre. According to Article 110 of Law 39/2022, all doors must open outwards without encroaching on public areas. Additionally, if your services include childcare, transport, meal provision, or other activities regulated by Article 2 of Law 17/2022, you must comply with the relevant requirements.
A key point to note: if meals are provided on-site, the food must strictly comply with the provisions of the Food Safety Law (Law 5/2013). In theory, small, unlicensed workshop-style suppliers may find it challenging to meet these requirements. However, as enforcement involves multiple departments, unless a major food safety incident occurs, routine inspections are typically not stringent. That said, operators are strongly encouraged to maintain self-discipline and adhere to regulations.
